AMERICAN THUNDERCAT RACING FEDERATION, INC.

2026/2027 PARTICIPANT RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, COVENANT NOT TO SUE, INDEMNIFICATION AND MEDIA AGREEMENT

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS.

1. SCOPE OF AGREEMENT

This Participant Release and Waiver of Liability, Assumption of Risk, Covenant Not to Sue, Indemnification and Media Agreement (“Agreement”) applies to all American Thundercat Racing Federation, Inc. (“ATRF”) events and activities in which I participate during the 2026 or 2027 calendar years, regardless of location.

This Agreement applies to all races, sanctioned events, competitions, practices, testing sessions, demonstrations, exhibitions, training activities, inspections, drivers’ meetings, staging, launching, recovery operations, setup and teardown activities, promotional activities, and any other activities organized, sanctioned, promoted, approved, or conducted by ATRF or occurring in connection with an ATRF-sanctioned event (collectively, “ATRF Activities”).

I understand and expressly agree that I am not required to execute a separate release for each ATRF Activity during 2026 or 2027 for this Agreement to apply. This Agreement is intended to apply separately and continuously each time I voluntarily participate in an ATRF Activity during the 2026 or 2027 calendar years.

2. ACKNOWLEDGMENT OF INHERENT AND OTHER RISKS

I understand that powerboat racing and related marine activities are inherently dangerous and involve substantial risks of serious bodily injury, permanent disability, paralysis, drowning, burns, traumatic injury, death, and property damage.

Risks include, but are not limited to:

• High-speed operation of powerboats;
• Collision with other boats, docks, seawalls, buoys, vessels, persons, structures, or other objects;
• Capsizing, flipping, spinning, sinking, or loss of control;
• Ejection from or impact within a boat;
• Contact with propellers or other moving equipment;
• Mechanical, steering, throttle, engine, structural, or equipment failure;
• Fire, explosion, fuel leakage, and fuel-related hazards;
• Wakes, waves, rough water, currents, changing water levels, and underwater or floating objects;
• Weather, wind, rain, lightning, heat, cold, reduced visibility, and changing environmental conditions;
• Actions, omissions, errors, or negligence of other racers, crew members, officials, volunteers, spectators, vessel operators, rescue personnel, or third parties;
• Delays, difficulties, or risks associated with emergency response, rescue, medical treatment, or transportation; and
• Other known and unknown, anticipated and unanticipated risks associated with powerboat racing and marine activities.

I understand that it is impossible for ATRF to identify or eliminate every risk associated with powerboat racing.

3. VOLUNTARY ASSUMPTION OF RISK

I voluntarily choose to participate in ATRF Activities with full knowledge that participation may result in serious injury or death.

I knowingly and voluntarily assume ALL RISKS OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS, whether known or unknown, foreseeable or unforeseeable, arising from or related to my participation in ATRF Activities.

THIS ASSUMPTION OF RISK EXPRESSLY INCLUDES RISKS ARISING FROM THE ORDINARY NEGLIGENCE OR FAULT OF ANY RELEASED PARTY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

4. RELEASE AND WAIVER OF LIABILITY

I EXPRESSLY RELEASE AND WAIVE CLAIMS AGAINST THE RELEASED PARTIES FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OR FAULT OF ANY RELEASED PARTY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

“Released Parties” means:

American Thundercat Racing Federation, Inc.; its officers, directors, members, employees, volunteers, officials, race directors, inspectors, contractors, agents, representatives, affiliates, sponsors, advertisers, promoters, sanctioning organizations, event organizers, participating clubs, property owners, venue operators, marina operators, governmental entities participating in or permitting an ATRF Activity, rescue and safety personnel, medical personnel, other participants, and each of their respective owners, officers, directors, employees, agents, representatives, affiliates, successors, and assigns.

To the fullest extent permitted by applicable law, I release and forever discharge the Released Parties from claims, demands, actions, causes of action, damages, liabilities, losses, costs, or expenses arising from or related to my participation in ATRF Activities, including claims for personal injury, death, or property damage resulting from the ORDINARY NEGLIGENCE OR FAULT OF A RELEASED PARTY.

This Agreement is not intended to release or waive liability for conduct that cannot legally be released or waived under applicable law.

5. COVENANT NOT TO SUE

To the fullest extent permitted by applicable law, I agree that I will not initiate or maintain a lawsuit, claim, arbitration, or other proceeding against a Released Party concerning any claim released by this Agreement.

6. INDEMNIFICATION AND HOLD HARMLESS

To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties from claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys’ fees arising from:

1. My acts or omissions;
2. My violation of ATRF rules or instructions;
3. My operation, ownership, maintenance, transportation, or use of my boat, motor, trailer, vehicle, equipment, or other property;
4. Injury or damage caused by me or my equipment to another person or property; or
5. Claims asserted by third parties arising from my participation in ATRF Activities.

This provision is not intended to require indemnification for conduct that cannot legally be indemnified under applicable law.

7. PARTICIPANT FITNESS AND RESPONSIBILITY

I represent that I am physically and mentally capable of participating in the ATRF Activities in which I voluntarily participate.

I understand that I am responsible for evaluating my own abilities, experience, physical condition, and readiness before participating.

I will immediately discontinue participation if I believe that I am unable to participate safely.

8. BOAT AND EQUIPMENT RESPONSIBILITY

I am solely responsible for determining whether my boat, hull, motor, propeller, steering system, throttle system, fuel system, electrical system, safety equipment, helmet, personal flotation device, protective equipment, racing equipment, trailer, and all other equipment are appropriate, properly maintained, compliant, and safe for participation.

I understand that ATRF may conduct technical inspections, safety inspections, equipment reviews, or other inspections for purposes of determining compliance with ATRF rules and event requirements.

ANY INSPECTION, APPROVAL, OR PERMISSION TO PARTICIPATE PROVIDED BY ATRF OR AN ATRF OFFICIAL DOES NOT CONSTITUTE A REPRESENTATION, CERTIFICATION, WARRANTY, OR GUARANTEE THAT MY BOAT, EQUIPMENT, OR PARTICIPATION IS SAFE, PROPERLY MAINTAINED, FREE FROM DEFECTS, OR SUITABLE FOR RACING.

I remain responsible for the condition, maintenance, preparation, and safe operation of my boat and equipment.

9. COMPLIANCE WITH RULES AND OFFICIALS

I agree to comply with ATRF competition rules, technical specifications, safety requirements, event procedures, applicable boating laws, and reasonable instructions issued by race and safety officials.

I understand that ATRF may refuse, suspend, or terminate my participation if an authorized official determines that I, my conduct, my boat, or my equipment does not comply with ATRF requirements or presents an unacceptable safety risk.

Such action does not create any representation or guarantee that participants who are permitted to participate are safe or free from risk.

10. ACTIONS OF OTHER PARTICIPANTS AND THIRD PARTIES

I understand that ATRF cannot control the actions of every racer, crew member, spectator, vessel operator, property owner, governmental agency, official, rescue provider, or other person.

I knowingly assume the risks associated with the acts, omissions, errors, negligence, or conduct of other persons encountered in connection with ATRF Activities, to the fullest extent permitted by applicable law.

11. EMERGENCY MEDICAL TREATMENT AND RESCUE

If I become injured, incapacitated, or otherwise unable to provide consent, I authorize reasonable emergency rescue, medical treatment, transportation, and related services deemed appropriate under the circumstances.

I understand that rescue, emergency medical, law-enforcement, fire, marine patrol, and transportation services may be provided by independent persons, organizations, or governmental entities.

ATRF does not guarantee the availability, response time, adequacy, effectiveness, or outcome of emergency medical or rescue services.

I am responsible for medical, rescue, transportation, and related expenses incurred on my behalf to the extent permitted by applicable law.

12. INSURANCE

I understand that I am responsible for determining whether I have adequate health, accident, disability, life, vessel, liability, property, and other insurance applicable to my participation.

I understand that any insurance maintained by ATRF is not a substitute for my own insurance and does not constitute a representation or guarantee that I, my boat, my equipment, or any particular occurrence will be covered.

13. PERSONAL PROPERTY

I am responsible for my boat, engine, trailer, vehicle, tools, equipment, racing equipment, and other personal property.

To the fullest extent permitted by applicable law, I assume the risk of loss, theft, or damage to my personal property associated with ATRF Activities.

14. ALCOHOL, DRUGS AND IMPAIRMENT

I agree not to operate or participate in the operation of a racing boat while impaired by alcohol, illegal drugs, controlled substances, medication, fatigue, illness, or any other condition that could materially impair my ability to participate safely.

I understand that ATRF may prohibit my participation if an authorized official reasonably believes I am impaired or otherwise unable to participate safely.

15. PHOTOGRAPHY, VIDEO, LIVESTREAM AND MEDIA RELEASE

I authorize ATRF and its authorized representatives to photograph, film, livestream, record, and otherwise capture my participation in ATRF Activities.

I grant ATRF a nonexclusive, royalty-free right to use my name, image, likeness, voice, team name, boat, racing number, photographs, video, audio, and recordings for event coverage, news, historical documentation, advertising, marketing, social media, livestreaming, broadcasts, websites, publications, and promotion of ATRF and Thundercat powerboat racing without additional compensation.

16. APPLICATION TO ALL 2026/2027 ATRF ACTIVITIES

I specifically understand and agree that this Agreement is intended to apply to every ATRF Activity in which I participate during the 2026 calendar year, regardless of whether:

• I pay a separate entry or registration fee;
• The Activity occurs at a different venue;
• The Activity occurs in a different state;
• I participate as a driver, co-driver, crew member, official, volunteer, or in another authorized capacity; or
• I execute an additional event-specific waiver.

An event organizer, venue, insurer, governmental entity, property owner, or ATRF may require an additional event-specific release or waiver. Execution of an additional release does not cancel or replace this Agreement unless ATRF expressly states otherwise in writing.

17. ELECTRONIC RECORDS AND ELECTRONIC SIGNATURE

I consent to executing this Agreement electronically and to ATRF maintaining an electronic record of my acceptance.

By entering my full legal name as my electronic signature and affirmatively selecting the required acceptance checkbox, I intend my electronic signature to have the same force and effect as my handwritten signature.

I understand that ATRF may maintain records identifying the date and time of acceptance, waiver version, electronic signature, registration information, and related transaction or registration records.

18. REGISTRATION AND PAYMENT

I understand that acceptance of this Agreement may be required as a condition of ATRF membership, registration, or participation.

Payment of membership dues, registration fees, entry fees, or other amounts by itself does not constitute execution of this Agreement unless I have also affirmatively accepted this Agreement through ATRF’s electronic registration process.

I understand that another person paying my registration or entry fee does not execute this Agreement on my behalf.

EACH PARTICIPANT MUST PERSONALLY ACCEPT AND EXECUTE THIS AGREEMENT.

19. GOVERNING LAW

Because ATRF Activities may occur in multiple jurisdictions, the enforceability and interpretation of this Agreement shall be determined under the law applicable to the particular ATRF Activity, transaction, or claim, including applicable federal maritime law when controlling.

Nothing in this Agreement is intended to waive rights or impose obligations that cannot lawfully be waived or imposed under applicable law.

20. SEVERABILITY

If any provision of this Agreement is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law.

The invalidity or unenforceability of one provision shall not invalidate the remaining provisions, which shall remain in full force and effect to the extent permitted by law.

21. ENTIRE AGREEMENT AND NO ORAL MODIFICATION

This Agreement represents my agreement with ATRF concerning the matters addressed herein and may not be modified by an oral statement made by an ATRF officer, director, employee, official, volunteer, or representative.

An additional event-specific agreement may supplement this Agreement.

22. ACKNOWLEDGMENT OF LEGAL RIGHTS

I HAVE CAREFULLY READ THIS ENTIRE AGREEMENT BEFORE ACCEPTING IT.

I UNDERSTAND THAT POWERBOAT RACING IS AN INHERENTLY DANGEROUS ACTIVITY THAT MAY RESULT IN SERIOUS INJURY, PERMANENT DISABILITY, PARALYSIS, DROWNING, OR DEATH.

I UNDERSTAND THAT I AM VOLUNTARILY ASSUMING SUBSTANTIAL RISKS.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.

I SPECIFICALLY UNDERSTAND THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS AGREEMENT RELEASES CERTAIN CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY THE ORDINARY NEGLIGENCE OR FAULT OF THE RELEASED PARTIES.

I UNDERSTAND THAT THIS AGREEMENT APPLIES TO ALL ATRF ACTIVITIES IN WHICH I PARTICIPATE DURING THE 2026 & 2027 CALENDAR YEARS.

I execute this Agreement knowingly, freely, and voluntarily and without coercion.

PARTICIPANT ELECTRONIC ACCEPTANCE

PARTICIPANTS UNDER AGE 18

A MINOR PARTICIPANT SHOULD NOT COMPLETE THE ADULT ELECTRONIC ACCEPTANCE ABOVE.

Any participant under age 18 must complete ATRF’s separate Minor Participant Agreement and Parent/Legal Guardian Consent, Release and Indemnification Agreement before participating in an ATRF Activity.
